Norwich Union should recoup the money it paid out to the infamous canoe couple to show that the industry will pursue fraudulent claims.
John Darwin and his wife Anne were charged with fraudulently obtaining insurance money after conspiring to fake his death.
Peter Chadborn, principal at CBK, said: "If the industry did not attempt to recoup its losses then it would be sending the wrong message to the consumer."
Agreeing, Jonathan French, spokesperson for the Association of British Insurers, said the firm was within its rights to get its money back and that Norwich Union was morally and legally right to pursue it.
Darren Dicks, head of protection marketing at Norwich Union, admitted that it had paid out to the canoe couple but a spokesman at the firm declined to comment further "as there are now ongoing criminal proceedings".
